AVADAN CREATIVE offers original decorative objects, design-based products, artistic pieces, and related items. Product descriptions, images, dimensions, colors, finishes, and materials are provided as accurately as possible.

Because some products may be handmade, made to order, hand-finished, painted, or produced in small batches, slight variations in color, texture, or finish may occur. These variations do not constitute defects but are part of the nature of the product.

3. Availability

All orders are subject to product availability. If a product becomes unavailable after an order has been placed, the customer will be informed as soon as possible and offered either a refund or, where appropriate, an alternative solution.

4. Prices

All prices shown on the Website are in euros (€) and shall indicate whether VAT is included or excluded, in accordance with applicable law.

Shipping costs, where applicable, will be clearly indicated before the order is completed.

AVADAN CREATIVE reserves the right to modify prices at any time, but changes shall not affect orders already confirmed.

5. Order Process

To place an order, the customer must follow the purchase steps indicated on the Website and provide the requested information.

Once the order is completed, the customer will receive an order confirmation by email. This confirmation does not affect any statutory consumer rights.

6. Payment

Accepted payment methods shall be those displayed at checkout.

By placing an order, the customer confirms that they are authorized to use the selected payment method.

AVADAN CREATIVE reserves the right to reject or cancel an order in the event of suspected fraud, unauthorized payment, pricing errors, or other legitimate grounds.

7. Shipping and Delivery

Orders will be shipped to the address provided by the customer during checkout.

Estimated processing and delivery times are provided for guidance only unless expressly stated otherwise. AVADAN CREATIVE shall not be liable for delays caused by shipping carriers, customs procedures, force majeure, or incorrect information provided by the customer.

The customer is responsible for ensuring that delivery information is accurate and complete.

8. Right of Withdrawal

If the customer is a consumer residing in the EU, they generally have the right to withdraw from the purchase within 10 calendar days from the date of delivery, without giving any reason.

To exercise the right of withdrawal, the customer must notify AVADAN CREATIVE by means of a clear statement sent to: hello@avadancreative.com

You may use the following model wording:

“I hereby give notice that I withdraw from my contract of sale of the following goods: [order details], ordered on [date] / received on [date], name: [name], address: [address], date: [date].”

If withdrawal applies, AVADAN CREATIVE will reimburse the amount paid for the returned product in accordance with applicable law, using the same payment method unless otherwise agreed.

9. Exceptions to the Right of Withdrawal

The right of withdrawal does not apply, among other cases permitted by law, to:

goods made to the customer’s specifications;
clearly personalized goods;
sealed goods not suitable for return for health or hygiene reasons once unsealed, where applicable;
services fully performed after prior express consent, where legally applicable.

If a product is custom-made, personalized, or produced to the customer’s specifications, this will be indicated in the product listing or before checkout whenever possible.

10. Returns for Damaged, Defective, or Incorrect Products

If the customer receives a product that is damaged in transit, defective, or incorrect, they must contact AVADAN CREATIVE as soon as possible at hello@avadancreative.com, providing the order number and clear photographs where relevant.

Where a lack of conformity exists, the customer will be entitled to the remedies provided by applicable consumer law.

11. Legal Guarantee

Consumers benefit from the legal guarantee of conformity established by applicable law.

AVADAN CREATIVE shall be liable for lack of conformity existing at the time of delivery and manifested within the legally established period.

This does not cover damage caused by misuse, accidents, negligence, improper handling, normal wear and tear, or unauthorized modifications.

12. Returns Procedure

Returned products must be sent back in appropriate condition, with all elements included, unless the return is due to defect or non-conformity.

Unless the return is due to an error attributable to AVADAN CREATIVE or to a legally recognized lack of conformity, the customer shall bear the direct cost of return shipping where permitted by law.

13. Intellectual Property

The purchase of a product does not transfer any intellectual property rights over the designs, branding, product concepts, photographs, renders, texts, or visual assets associated with AVADAN CREATIVE.

No reproduction, commercial exploitation, resale of protected designs, copying of product listings, or unauthorized use of brand assets is permitted.

14. Limitation of Liability

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

To the maximum extent permitted by law, AVADAN CREATIVE shall not be liable for indirect or consequential losses, or for delays and failures caused by events beyond reasonable control.
